Court approves settlement and attorneys’ fees in our lawsuit claiming New Balance toning shoes were falsely advertised
Yesterday in federal court, at a hearing for final approval, the judge approved a class action settlement against New Balance and also determined that New Balance should pay the fees and costs of the Plaintiffs’ attorneys. New Balance agreed to pay up to $3.75 million to settle claims that the company misrepresented the benefits of wearing Toning Shoes to consumers.
You are a class member if you purchased toning shoes from January 1, 2010, through August 29, 2012. Each class member could receive up to $100 for each pair of shoes purchased, although this amount will decrease as more class members choose to participate. Class members must fill out a form to obtain money from the settlement.
The civil lawsuit was filed on January 3, 2011, in federal court in Massachusetts. The lawsuit was brought by the California law firm of Ahdoot & Wolfson, PC, with our firm as local counsel.
