Cunniffe, the case our firm handled in the U.S. Court of Appeals for the First Circuit, which makes it crystal clear that the public has a First Amendment right to record police officers performing their public duties in public. We hope that those federal appeals courts that have yet to decide this issue will also recognize the important right to videotape police officers in a public space.
